1. Who we are and scope of these terms
These Terms of Service govern your use of the OKIPA Charitable Foundation website and the website-related donation, event, and communication activities described here. “Foundation,” “we,” “us,” and “our” mean OKIPA Charitable Foundation; “you” means the person using the website or participating in these activities.
By using this website, you agree to these terms to the extent permitted by applicable law. If you do not agree, please do not use the website. Separate written agreements or terms expressly presented for an event, sponsorship, or other activity govern that activity where they conflict with these general terms. Text messaging requires a separate affirmative opt-in; visiting this website or accepting these terms does not enroll you in texts.
2. Eligibility and accurate information
You must have legal capacity to enter into a transaction. A minor may make a donation or register for an activity only with the authorization and involvement of a parent or legal guardian. You must provide accurate information, use only payment methods you are authorized to use, and not impersonate another person.
If you submit information on behalf of an organization, you represent that you are authorized to do so. Do not submit another person’s phone number to enroll them in our texting program.
3. Donations and non-refundable gifts
All donations to OKIPA Charitable Foundation are final and non-refundable, except where a refund is required by applicable law. Please review the amount, recipient, and payment details before completing your donation. A change of mind, change in personal circumstances, or inability to attend an event does not entitle you to a donation refund.
Donations are processed through Stripe. Your payment is also subject to applicable Stripe and payment-network terms. We do not authorize anyone to use a payment method without the payment holder’s permission. If you believe a charge was unauthorized, duplicated, or processed incorrectly, promptly contact us and your payment provider so the issue can be investigated. This policy does not limit statutory rights or your right to report an unauthorized transaction.
If recurring giving is offered and you expressly authorize it, charges continue according to the schedule disclosed at checkout until you cancel. Contact us to cancel future installments. Cancellation does not refund completed donations; processing already underway may require coordination with the payment provider.
A donation is not a purchase of medical services and does not guarantee assistance, a particular outcome, or preferential treatment. Any gift restrictions must be expressly accepted by the Foundation in writing. Unless we accept a restriction, we may apply gifts to our charitable work and operating needs.
Tax treatment depends on applicable law, the Foundation’s status, and any goods or services received in return. We do not promise that every payment is tax-deductible. Retain your payment records and consult a qualified tax adviser; a payment confirmation alone is not a guarantee of deductibility.
4. Events, tickets, and sponsorships
Event dates, venues, availability, and arrangements may change. Ticket purchases and sponsorship commitments, if offered, are subject to the specific terms disclosed before payment or in a separate written agreement. The non-refundable donation rule does not automatically determine the treatment of a separate ticket purchase or sponsorship payment.
We will communicate material event changes using the contact details provided. Any benefits, cancellation terms, or tax disclosures for a paid event must be reviewed at registration. Nothing on this website guarantees participation or a sponsorship benefit that has not been expressly confirmed.
5. Text messages and electronic communications
We send optional transactional text messages and reminders to people who affirmatively opt in through our online forms. Message frequency varies with your interactions and scheduled reminders. Message and data rates may apply. Consent to texts is not a condition of donating, purchasing, participating, or receiving assistance.
Reply STOP to unsubscribe or HELP for help. You may also contact Brittany@okipacf.org for support or to withdraw consent. Carriers are not liable for delayed or undelivered messages. Our SMS Terms describe the program in detail, and our Privacy Policy explains how messaging information is handled. We will not treat your transactional opt-in as consent to marketing or fundraising text messages.
We may use the contact details you provide to respond to your inquiries and send relevant donation confirmations or event communications. SMS consent is separate from other communications. Do not rely on email or text messages for emergencies or time-critical medical matters.
6. No medical, legal, or tax advice
Website content is for general information about the Foundation and its work. It is not medical, insurance, legal, or tax advice, does not establish a physician-patient relationship, and is not a substitute for advice from an appropriately qualified professional. Do not send medical records or sensitive health information through general website forms or text messages. In an emergency, call 911 or your local emergency number.
7. Permitted use and intellectual property
You may access the website for lawful personal or organizational purposes relating to the Foundation. You may not interfere with its operation, attempt unauthorized access, introduce malicious code, scrape personal information, submit fraudulent payments, harass others, or use the Foundation’s name to misrepresent an affiliation or solicit funds without authorization.
Website text, designs, logos, photographs, and other materials belong to the Foundation or their respective owners and are protected by applicable intellectual-property laws. You may view and share links to public pages. Reproduction, commercial use, or use of our marks implying endorsement requires prior written permission, except as otherwise permitted by law.
You retain rights in information you submit. You grant us only the permission reasonably necessary to review and respond to your submission and administer the activity you requested. Submission does not give us permission to publish your testimonial, photo, or personal story without appropriate separate authorization.
8. Privacy and third-party services
Our Privacy Policy describes personal-information handling. The website may link to services operated by others, including Stripe. Those services have their own terms and privacy practices. A link does not imply endorsement, and we do not control third-party content or availability. Review those policies before submitting information directly to another service.
9. Availability, disclaimers, and liability
We aim to keep website information accurate, but content may be incomplete or out of date. To the fullest extent permitted by law, the website is provided “as is” and “as available,” without warranties of uninterrupted availability, accuracy, fitness for a particular purpose, or freedom from harmful components. We may correct errors, modify content, or restrict misuse of the website.
To the fullest extent permitted by law, the Foundation is not liable for indirect, incidental, consequential, special, or punitive damages arising from website use or inability to use it. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, or other conduct where applicable law prohibits a limitation. Mandatory consumer rights remain unaffected.
10. Applicable law and resolving concerns
To the extent permitted by applicable law, these terms are governed by the laws of Oklahoma, without regard to conflict-of-law rules. Mandatory protections and rights under laws applicable to you remain in effect. These terms do not impose mandatory arbitration or waive any non-waivable right to bring a claim.
Please contact us first with a question or concern so we can try to resolve it. If a provision is found unenforceable, the remaining provisions continue to apply to the extent legally permitted. Our failure to enforce a provision on one occasion is not a waiver of it.
11. Changes to these terms
We may update these terms and will post the revised version with an updated date. Changes apply prospectively and do not retroactively change completed donation terms or eliminate accrued rights. We will provide additional notice or obtain consent where legally required. Updated terms do not expand your SMS consent; new messaging purposes require appropriate separate consent.
